ACM decision not to regulate KPN’s B2B fibre services upheld by appeals court

The Netherlands’ apex administrative court, the Trade & Industry Appeals Tribunal (College van Beroep voor het bedrijfsleven, CBb), has upheld telecoms regulator ACM’s decision to refrain from regulating the business fibre broadband access market. As reported by Dutch-based Telecompaper, the CBb ruling brings to an end an appeal brought by VodafoneZiggo, T-Mobile, Tele2 and nine other parties against the decision not to regulate incumbent PSTN operator KPN’s B2B fibre services.
