Appeal against KPN’s 2014 Reggefiber takeover quashed by apex court

16 Feb 2018

The apex administrative court in the Netherlands, the Trade & Industry Appeals Tribunal (College van Beroep voor het bedrijfsleven, CBb), has given a final verdict dismissing an appeal against incumbent telco KPN’s 2014 takeover of open fibre network operator Reggefiber. The Authority for Consumers & Markets (Autoriteit Consument & Markt, ACM) approved the merger in October 2014, and in May 2016 the District Court of Rotterdam rejected an appeal against the ACM’s decision brought by Vodafone Netherlands (now part of VodafoneZiggo), which subsequently took its appeal to the CBb.
