Canadian cellco Globalive Wireless (Wind Mobile) has confirmed that it will appeal a decision of the Federal Court on 4 February which reversed the federal cabinet’s approval of Wind’s ownership. The court decision gave Wind – backed by Egypt’s Orascom – 45 days to comply with foreign ownership laws, but the company is asking for an extension to the stay period. Last week Industry Minister Tony Clement announced the federal government is also appealing the latest court judgement, which reinstates an original ruling from the telecoms regulator the CRTC saying that Wind is effectively controlled by non-Canadians due to Orascom holding the vast majority of its debt.
