Court rejects Rogers’ objection to Shaw buying Mountain Cablevision

Shaw Communications’ purchase of smaller cableco Mountain Cablevision has been given the all-clear after the Ontario Superior Court of Justice dismissed a motion filed by rival Rogers Communications seeking to block the acquisition based on a non-compete agreement in Ontario struck with Shaw nearly ten years ago. Although the judge’s decision agreed with Rogers that the acquisition of Mountain, based in Hamilton, southern Ontario, is contrary to the non-competition covenant, it also ruled that the arrangement was restrictive of trade. Alberta-based Shaw will now acquire Mountain’s customer base of around 41,000 basic cable subscribers, 28,000 cable modem internet users and 27,000 cable telephony customers.
