KPN fails in bid to open Dutch cablenets

The Dutch cable network operators Casema, Essent, Multikabel, UPC, and Delta Kabel have reportedly won their appeal against the regulator, OPTA’s, March decision on broadcast distribution services in the Netherlands. Several press sources note that the business tribunal (College van Beroep voor het bedrijfsleven, CBb) has overruled the regulator’s ruling which ordered all cablecos to open up their networks to other providers of broadcast distribution services and also to provide unbundled services. The decision also means cablecos will not have to provide information on how they assess and decide their rates. The court judged that OPTA had provided insufficient information to underpin its 2006 rulings.
