Court overturns arbitration ruling in favour of TOT

The Administrative Court in Thailand has accepted telco TOT Corp’s petition to overturn an arbitration ruling in January ordering it to pay THB9 billion (USD240 million) to rival True Corp to settle network access charge claims dating from 1990 to 2002. Under the previous ruling TOT would face additional payments to settle claims from 2002 to the present, based on a 50% split of benefits gained by TOT for using True’s networks. TOT claims that in awarding the earlier judgement to True, the arbitration panel failed to clarify how it had assessed the award.
