Ireland’s Electronic Communications Appeals Panel (ECAP) has rescinded the significant market power (SMP) designation handed to mobile operator Hutchison 3G Ireland by regulator ComReg a full year before it had launched services. ECAP said that ComReg had been unable to fully justify its decision and had not fully examined all of the relevant factors before branding H3G Ireland with SMP. The recently launched 3G operator said it felt vindicated by the decision. ‘We felt that a finding of SMP was akin to a finding of dominance in competition law,’ Graeme Slattery, head of communications for H3G Ireland, told ElectricNews.Net. ‘How could we be dominant if we hadn’t even launched?’
