ComReg declares – ‘mmO2 and Vodafone have SMP

Ireland’s industry watchdog ComReg has officially designated Vodafone and mmO2 as having significant market power (SMP) in Ireland. The announcement comes in the wake of an EU ruling in support of the regulator that the two companies must open their networks to competitors. In a move that could pave the way for legal action to overturn the cellcos’ de facto duopoly, ComReg says that the situation ‘will continue in the absence of appropriate regulatory action’. The ruling opens the way for the regulator to impose an obligation on Vodafone and mmO2 to open their networks to MVNOs, with Hutchison Whampoa and eircom among those thought to be interested in entering the market.
